Throughout these Terms, the terms “WRBL”, “we”, “us” and “our” refer to the business operated by Sergei Pestretsov.

The terms “customer”, “you” and “your” refer to any person purchasing products through our website.

By placing an order, you acknowledge that you have read and accepted these Terms and Conditions of Sale.

These Terms apply to purchases made by consumers and, where applicable, professional customers. Mandatory consumer protection rights remain unaffected.

2. Products

WRBL offers artist-designed temporary tattoos and related artistic products.

Each product listing provides information about the product, including its design, format, available options and other relevant characteristics.

Temporary tattoos are intended for external application to the skin in accordance with the instructions supplied with the product.

Customers should carefully read the product description and application instructions before use.

Product photographs are provided for illustrative purposes. Actual colours and visual details may vary slightly depending on screen settings, lighting conditions and the display device used.

We make reasonable efforts to ensure that product descriptions and images are accurate. If a product differs materially from its description, the customer’s statutory rights remain unaffected.

Product availability may change without notice. If we cannot fulfil an accepted order, we will inform the customer and refund any amount paid for the unavailable products.

3. Prices and Taxes

All prices are displayed in the currency indicated on the website.

The applicable price is the price displayed at the time the customer places the order.

Shipping costs and any additional charges applied by WRBL are displayed before the customer completes the purchase.

WRBL currently operates under the French VAT exemption regime known as franchise en base de TVA, subject to the applicable legal conditions.

Where applicable, invoices may include the statement:

“TVA non applicable, article 293 B du Code général des impôts.”

The tax treatment of a transaction may depend on the customer’s location, the destination of the goods and applicable tax rules.

For deliveries outside the European Union, import duties, customs charges, import VAT and other local charges may apply. Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer.

Customers are responsible for checking any import requirements applicable in their country.

4. Orders

Customers may place orders through the online store by selecting products, adding them to the shopping cart and completing the checkout process.

Before submitting an order, customers should verify their selected products, quantities, delivery address, contact details and total price.

The customer is responsible for providing accurate information when placing an order.

By submitting an order through a payment button clearly indicating an obligation to pay, the customer confirms their intention to purchase the selected products and pay the displayed amount.

After an order is submitted, the customer will receive an order confirmation by email.

An order confirmation acknowledges receipt of the order. If we cannot fulfil the order, we will contact the customer and arrange a refund for any payment received for the unfulfilled order.

We reserve the right to contact customers to clarify incomplete or inconsistent order information.

If a suspected fraudulent transaction or payment issue prevents us from processing an order, we may suspend processing while the issue is investigated, subject to applicable law.

5. Payment

Payment must be completed through the payment methods made available at checkout.

Available payment methods may include credit cards, debit cards and other payment services supported by the store.

Payment is processed through the relevant payment provider. WRBL does not intentionally collect or store complete payment card details when these are processed directly by the payment provider.

Orders are normally prepared after payment has been successfully authorised or received.

If a payment fails or is declined, the order may not be processed until the payment issue is resolved.

6. Shipping and Delivery

Orders are generally prepared for dispatch within 1–2 business days, unless another processing period is stated on the website or communicated to the customer.

Processing times do not include weekends or public holidays.

Delivery estimates depend on the destination, shipping method and postal service. Any estimated delivery time displayed at checkout or in our Shipping Policy is indicative unless a specific delivery date has been expressly agreed.

If no delivery date or period has been agreed, applicable French consumer law generally requires delivery without undue delay and no later than 30 days after the conclusion of the contract.

Customers should provide a complete and accurate delivery address.

WRBL cannot guarantee delivery to an incorrect or incomplete address supplied by the customer. However, this does not exclude any rights the customer may have under applicable law.

If a parcel is delayed, appears lost or arrives damaged, the customer should contact us at:

pestretsov.sergei@gmail.com

We will investigate the issue and work with the relevant shipping provider to determine the appropriate resolution.

Risk of loss or damage to goods generally passes to a consumer when the consumer, or a third party designated by the consumer other than the carrier, physically takes possession of the goods. Exceptions may apply where the consumer independently commissions a carrier not offered by the seller.

For further details, please consult our Shipping Policy.

7. Right of Withdrawal — European Union

Consumers residing in the European Union generally have the right to withdraw from a distance purchase within 14 calendar days of receiving the goods, without giving a reason, subject to the statutory exceptions.

Where an order contains multiple goods delivered separately, the withdrawal period generally begins when the consumer receives the last good.

To exercise the right of withdrawal, the customer must inform WRBL of their decision within the applicable period.

Customers may contact us at:

Email: pestretsov.sergei@gmail.com

Customers may use the model withdrawal form included below or send another clear statement expressing their decision to withdraw.

Where the right of withdrawal applies, the customer must return the goods within 14 days of notifying us of the withdrawal.

Unless the goods are defective or another legal rule requires otherwise, the customer bears the direct cost of returning goods following withdrawal. We will refund the standard delivery cost originally paid where required by law. Any additional delivery cost resulting from the customer’s choice of a more expensive delivery method may be excluded from the refund.

We may withhold reimbursement until we have received the returned goods or the customer has supplied evidence of having sent them back, whichever occurs first, unless applicable law requires otherwise.

Hygiene and Sealed Products

Certain products may be excluded from the right of withdrawal under applicable law if they are sealed goods that are not suitable for return for reasons of health protection or hygiene and the customer has unsealed them after delivery.

This exception applies only where the legal conditions are actually met. It does not automatically apply to every temporary tattoo or to every opened parcel.

Any applicable restriction must be assessed in light of the product, its protective seal and the circumstances of the return.

Nothing in this section limits the customer’s statutory rights concerning defective, damaged or non-conforming goods.

Online Withdrawal Facility

Where required by applicable law, customers may exercise their right of withdrawal through the online withdrawal facility provided on the website.

The facility must be accessible during the statutory withdrawal period. Instructions on how to locate and use it should be provided before the customer completes their purchase.

8. Returns and Refunds

Returns and refunds are handled in accordance with applicable consumer law and our Refund and Returns Policy.

Customers should contact us before returning a product so that we can provide the relevant return instructions.

Returned goods should be packaged securely to prevent damage during transit.

For a voluntary return or withdrawal, products should be returned in the condition required by applicable law. Where the customer has handled goods beyond what is necessary to establish their nature, characteristics and functioning, the customer may be liable for any resulting reduction in value, where permitted by law.

Products that are defective, damaged or materially different from the order are handled separately under the applicable statutory rights.

We will not use our return policy to exclude or restrict mandatory consumer protections.

Refunds will be made using the original payment method unless the customer expressly agrees otherwise and the alternative method is legally permitted.

For further information, please consult our Refund and Returns Policy.

9. Incorrect, Damaged or Defective Products

If a customer receives an incorrect, damaged or defective product, they should contact us as soon as reasonably possible at:

pestretsov.sergei@gmail.com

Please provide the order number and a description of the issue. Photographs may help us assess the problem, but the absence of photographs will not automatically remove any statutory rights the customer may have.

Depending on the circumstances and applicable law, the customer may be entitled to replacement, repair where relevant, a price reduction or a refund.

Where the legal guarantee of conformity applies, the customer is not required to pay costs that the law places on the seller.

Nothing in these Terms limits the customer’s rights under the French legal guarantee of conformity or the guarantee against hidden defects.

10. Legal Guarantees

Consumers benefit from the statutory guarantees provided by applicable law, including the legal guarantee of conformity and the guarantee against hidden defects.

Legal Guarantee of Conformity

Under the French Consumer Code, the seller is liable for a lack of conformity that becomes apparent within the applicable statutory period. For new goods, the legal guarantee of conformity generally applies for two years from delivery.

Where the legal conditions are met, the consumer may request that the goods be brought into conformity through repair or replacement, or obtain a price reduction or termination of the contract where legally available.

The remedies available depend on the nature of the defect and the statutory conditions.

Guarantee Against Hidden Defects

Consumers may also benefit from the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

These statutory guarantees apply independently of any voluntary commercial guarantee.

Nothing in these Terms excludes or limits rights that cannot legally be waived.

Official information is available through Service Public — Legal Guarantees for Consumers.

11. Product Use and Safety

Customers must follow the product-specific application and removal instructions supplied with their temporary tattoos.

Before application, customers should read all warnings and check the product information.

Do not apply a product contrary to its instructions. Avoid application to irritated, damaged or broken skin and discontinue use if an adverse reaction occurs.

Customers with known sensitivities to product ingredients should review the relevant product information before use.

WRBL does not recommend using products in ways that are inconsistent with their intended purpose or instructions.

Any product-specific safety information displayed on the product listing or packaging should be read before use.

Nothing in this section excludes any liability that cannot be excluded under applicable law.

12. Promotions and Discount Codes

From time to time, WRBL may offer promotions, discount codes or special offers.

Unless otherwise stated, promotional offers are subject to the conditions displayed at the time they are offered.

A discount code may be limited by validity period, product selection, minimum order value or other clearly communicated conditions.

Promotions cannot be exchanged for cash and may not be combined with other offers unless expressly stated.

If a promotion is cancelled or modified, this will not affect orders already accepted, except where required by law.

13. Personal Data

Personal data provided during the ordering process is processed for purposes including order management, payment processing, delivery, customer service and compliance with legal obligations.

Personal data may be shared with service providers where necessary to operate the store and fulfil orders, subject to applicable data protection law.

Further information about the collection and use of personal data, cookies, retention periods and customer rights is provided in our Privacy Policy.

14. Complaints and Dispute Resolution

Customers are encouraged to contact us first if they have a question, complaint or concern about an order.

Email: pestretsov.sergei@gmail.com

Postal address:
WRBL — Sergei Pestretsov
9 rue du Bélier
69002 Lyon
France

We will make reasonable efforts to resolve complaints directly and reach a fair solution.

If a dispute cannot be resolved directly, consumers may be entitled to seek assistance through an appropriate consumer dispute resolution procedure, including consumer mediation where applicable under the laws of their country of residence.

Consumers residing in France may have the right to refer an eligible dispute to a consumer mediator in accordance with applicable French law.

Nothing in this section limits any statutory rights consumers may have to seek mediation or bring proceedings before a competent court.

For international orders, mandatory consumer protection rules applicable in the customer’s country of residence remain unaffected.

15. Applicable Law

These Terms and Conditions are governed by French law, subject to any mandatory consumer protection provisions that apply in the customer’s country of residence.

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

Nothing in these Terms excludes or restricts any rights that cannot legally be excluded or restricted.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, website or applicable law.

The latest version will be published on the website with its updated date.

The version applicable to an order is generally the version presented to the customer when the order was placed, subject to mandatory legal requirements.
